Brazilian criminals of January 8th seek asylum in Argentina

Argentina received a request for asylum from Bolsonaro supporters who were fugitives from justice, for the criminal acts of January 8, 2023. The request will be evaluated and there is no deadline for responses. The analysis will be carried out by the country's National Refugee Commission. The asylum request made by the Brazilians followed Argentine legislation.

Asylum requests from Brazilian refugees in Argentina will be analyzed on a case-by-case basis, but at least 60 asylum requests have been formalized in the neighboring country. It is not yet known how many requests were actually made and whether or not extradition requests were carried out.

Case-by-case analysis

In a press conference, the spokesperson for the pink house, Manuel Adorni, stated that requests will be analyzed on a case-by-case basis, and also said that the management will do everything that the law indicates, including passing on information to the Brazilian authorities. The analysis will be composed of representatives from the Ministry of the Interior, Foreign Affairs and other departments.

The Federal Government's estimate is that at least 60 people have formalized their asylum request in the neighboring country. These refugees are being investigated or convicted for the acts of January 8, 2023.

The Brazilian government's objective is to extradite these refugees to Argentina, however the request has not yet been formally presented.

The extradition process

After the list of refugees was ready, it was sent to the Federal Supreme Court (STF), and minister Alexandre de Moraes, who is the rapporteur of the case at the supreme court, included these names in the process to make the extradition request.

The request must be sent to the Ministry of Justice and Public Security, and then the request is filed with the Ministry of Foreign Affairs of Brazil, which, in turn, contacts the Ministry of Foreign Affairs of Argentina, where it is made the procedure for requesting the extradition of these people.

A first instance judge in Argentina is analyzing the case, but the final decision is made by the President of the Republic, Javier Milei.

It is worth remembering that the president of Argentina is an ally of the former president of Brazil Jair Bolsonaro. Milei is one of the inciters of the acts of January 8, 2003.
