Chamber approves harsher penalties for homicides against LGBT+ group

This Friday (5), the Chamber Committee approved the greater penalty for crimes motivated by discrimination against the LGBT+ group, the penalty can reach up to 30 years in prison in a closed regime and without the right to pay bail.

Homicides motivated by discrimination against LGBT+ people will be considered heinous crimes and will result in a prison sentence. Depending on the crime, the sentence may be up to 30 years in prison and the right to bail for release will be lost.

Bill and proposed changes

The bill aims to increase prison terms for crimes against LGBT+ people. Prison terms range from 12 to 30 years in a closed regime, with no right to bail for release. First, this bill will go through a process before it comes into effect. It will still be analyzed by the Constitution and Justice Committee (CCJ) and the Chamber of Deputies. It will then also be analyzed by the Senate.

To achieve this, there will be some changes, including the longest sentence for this type of homicide, 30 years, unlike common homicides which have a maximum sentence of 20 years, the sentence will be served in a closed regime and there will be no right to amnesty, bail or to respond in freedom.

Dandara Law

The bill is named or nicknamed the Dandara Law, and is a tribute to Dandara dos Santos, a transvestite who was shot dead in Fortaleza, Ceará, in 2017. The author of the law is PT deputy Luizianne Lins, who expressed her joy on social media about the approval of the bill.

She even says that it is a great achievement for the right to life of the LGBT+ person, and hopes for its approval in the “house”. Deputy Erika Kokay says that this project is important for the LGBT+ group and that they will continue fighting for the bill to also be approved by the CCJ.
