Donald Trump has suspended penalty in fraud case involving former porn star

This Friday (10), the president-elect of the United States, Donald Trump, obtained an “unconditional discharge” and will not be arrested or fined for the fraud case involving former porn actress Stormy Daniels.

In a new trial held today in New York, the United States Supreme Court decided to uphold Trump's conviction on charges of accounting fraud involving undeclared payments to the porn actress, in the amount of US$130,000. However, by obtaining a waiver, Trump will not need to serve any sentence and is also exempt from paying a fine.

With ten days remaining before assuming his second term at the head of the White House, the judge responsible, Juan Merchan, took into account the Republican's victory in the presidential elections and decided to exempt him from the penalties, as complying with them would hinder his mandate. . It is worth remembering that, even with the sentence handed down, the conviction suffered by Donald Trump will remain on his criminal record, which will make him the first president in history with a criminal record to take over the administration of the most important economy in the world.

In a statement on his Truth social network account, Donald Trump again claimed innocence and stated that the entire process was unfair. He also said that everything was nothing more than political persecution by those who want to hinder him in his project of making America great once again.

In another part of the post, Trump defined the process as a pathetic game of “witch hunt” on the part of the Democrats and noted that the sentence proves that everything was always a huge farce, making it clear that he will ask for the conviction to be annulled.

Understand the case

In May 2024, Donald Trump was convicted on 34 charges related to the fraud case, for not omitting payments made to former porn actress Stormy Daniels, made in an attempt to silence her about the extramarital affair that occurred between the two in 2006.

According to American justice, the payments were made shortly before the 2016 presidential elections. At the time, those responsible for the then Republican candidate's political campaign feared that the revelations would negatively influence Trump's electorate, mainly due to the fact that the extramarital affair occurred shortly after the birth of his youngest son with Melania Trump.

Still in 2024, the United States Supreme Court ruled that former presidential candidates could not be prosecuted for acts committed during their terms in office, which raised hopes of annulment of Donald Trump's entire conviction. In December of the same year, based on the Court's decision, the politician's lawyers filed an appeal asking for the entire process to be annulled. However, as the case occurred before the politician assumed the White House, the judge responsible, Juan Merchan, denied the request and stated that the immunity granted by the Court would not apply to the case.
