Lula sanctions new General Sports Law

This Wednesday (14th), President Luiz Inácio Lula da Silva sanctioned the General Sports Law, which had already been in process since 2017. The National Congress approved the text last month, which regulates the practice of sports in the country in a only law. Now, LGE encompasses all laws related to Brazilian sport, such as the Pelé Law, the Fan Statute, the Sports Incentive Law and the Bolsa Atleta.

The text was published today, Thursday (15), in the Official Gazette of the Union, with some vetoes from the president. Among them is the most controversial point of the law, which has generated numerous protests from players in recent games. This point concerned the flexibility of the compensatory clause for athletes in employment contracts.

The flexibility of the compensatory clause refers to a change in the regulation that would allow the reduction or modification of the values ​​previously agreed in an athlete’s employment contract. This clause is commonly used to guarantee financial compensation in case of early termination of the contract, in order to protect the interests of the club or the athlete. However, the flexibility of this clause refers to the possibility of reducing or changing the established values, which triggered protests on the part of the players.

The veto also came to the creation of the National Authority for the Prevention and Combat of Violence and Discrimination in Sport (Anesporte), the presidency justified the veto as “initiative vice”, refers to an irregular situation or failure in the legislative process, in which a bill is presented by an authority or body that does not have the legal competence to do so.

Another important veto of the text was the non-creation of the National Sports Fund (FNE), the justification for the veto being that there was no revenue forecast for the institution.

The recent General Sports Law (LGE), composed of approximately 200 articles, establishes the recognition of sport as an activity of great social relevance. It emphasizes the importance of the principles of financial and administrative transparency, promoting integrity in sports management and emphasizing social responsibility. In addition, the law addresses the National Sports System (Sinesp), establishing guidelines and mechanisms for its implementation.
