prosecutor files petition to reduce sentence

Attorney George Gascón, from Los Angeles County, reiterated this Thursday (24) that he will file a petition in the Court of that city seeking to reduce the sentences of Erik and Lyle Menéndez, sentenced to life in prison.
The alleged reason
In a statement to the press, the person responsible for the Menéndez brothers' cases stated that he decided on the request after carefully reviewing the current sentence. He advocates that the sentence be reduced to 50 years, which, in practice, would make the brothers eligible for parole: “I have reached a point where I believe that under the law re-sentencing is appropriate. They have been in prison for almost 35 years. I believe they have already paid their debt to society.”said the prosecutor, not without first observing that the brothers practiced rehabilitative conduct in prison.

The process is not so simple, as a judge must approve the request previously analyzed by a prosecutor. If the corrected sentence is approved, the Menéndez brothers will need to appear before the State Parole Hearing Board to decide whether they are eligible to be released. The judge also needs to listen to the Menéndez family, as some relatives support their release, when, however, Uncle Milton Andersen, brother of Kitty, their mother, opposes the release. The judge may deny the request if he believes the brothers still pose a risk to the community.
Not everyone agrees
Kathleen Cady, Milton's lawyer, criticized Gascón's initiative for not informing her client of the development of the case, stating that Mr. Milton Andersen believes that justice was done when the jury found Erik and Lyle Menéndez guilty of the multiple murders and the judge sentenced them to life in prison, with no chance of parole.
Brothers Lyle and Eric Menéndez made headlines in the United States in 1993 after being accused of murdering their parents in 1989. The two men, who claimed self-defense, were convicted and remain in prison.
