It is often a bumpy road, but surrogacy can be a solution for people who cannot become pregnant themselves. In Belgium, there are several fertility centers that guide this process. Who is eligible and how does the whole process work?

What is surrogacy?

Surrogacy means that a surrogate mother becomes pregnant and gives birth to a child who then goes to the intended parents or social parents. In doing so, she gives up all rights and obligations that come with parenthood.
There are two forms of surrogacy: low-tech surrogacy, where the surrogate mother is impregnated with the sperm of the intended father. High-tech surrogacy means that an embryo from the intended parents is implanted in the surrogate mother.

Legislation in Belgium

Surrogacy in Belgium is not regulated by law, but it is not prohibited either. What is prohibited is that the intended parents give money to the surrogate mother. Because there is no legal framework, there is sometimes abuse and surrogacy issues can lead to painful lawsuits.

There are a few conditions. Surrogacy is possible if the intended mother cannot carry a child herself for medical reasons, for example if her uterus is missing, if a pregnancy would be life-threatening or if she has had several unexplained miscarriages. Homosexual people who want to have children can also use a surrogate mother.

Procedure

Gathering information is always the first step before a couple actually starts the surrogacy process. The fertility center will try to give the best possible picture of the procedure. In addition, you can also consult a family lawyer who will help you draw up a letter of intent. Although this statement is not legally enforceable, it does show that possible problems and solutions have already been considered in advance.
  1. Finding a surrogate mother: the intended parents themselves are responsible for finding a surrogate mother. It is often difficult to find someone who is willing to do this. Most intended parents look for a surrogate mother in their immediate environment.
  2. The screening and fertilization take place in a fertility center. Both the intended parents and the surrogate mother are screened. Not only medical matters will be examined, but also psychological and social circumstances. Afterwards, the fertilization process starts with the surrogate mother.
  3. In low-tech surrogacy, the surrogate mother is fertilized through artificial insemination. In high-tech surrogacy, in vitro fertilization (IVF) is needed to implant the embryo of the intended parents in the surrogate mother. If all goes well, the fertilization results in a pregnancy. The surrogate mother chooses which hospital she will give birth in.
  4. Once the baby is born, the intended parents become the social parents, but they are not yet legal parents. The intended parents can only adopt the child two months after the birth. Until then, the surrogate mother remains the legal mother. If the surrogate mother is married, her husband is automatically the legal father. The adoption procedure in Belgium quickly takes two years. After that period, the intended parents are the legal parents of the child.
