California Governor Gavin Newsom on Sunday vetoed a widely contested artificial intelligence security bill following objections raised by the technology industry, which claims the law could drive AI companies away from the state and harm innovation.
Newsom said the bill “does not take into account whether an AI system is deployed in high-risk environments, involves critical decision-making, or the use of sensitive data” and that the law would apply “rigorous standards to even the most basic functions .
Newsom said he has asked generative AI experts to help California “establish practical boundaries” that focus “on developing empirical, science-based trajectory analysis.” He also ordered state agencies to expand their assessment of the risks of potential catastrophic events related to the use of AI.
Generative AI has generated a lot of excitement, but also concerns that it could make some jobs obsolete, interfere in elections, and potentially take over humans, causing catastrophic effects.
The bill's author, Democratic state Sen. Scott Wiener, said the legislation was needed to protect the public before advances in AI become uncontrollable. The AI industry is growing rapidly in California, and some leaders have questioned the future of these companies in the state if the bill passes.
Wiener said the governor's veto makes California less safe and means that “companies that aim to create extremely powerful technology will not face mandatory restrictions.” He added that “voluntary industry commitments are not enforceable and rarely work well for the public.”
The governor said he will work with the state legislature on an AI proposal next session. This comes as legislation in the US Congress to establish safeguards is stalled, and the Biden administration's AI regulatory oversight proposals move slowly.
Newsom stated that “a California-only approach may be justified, especially in the absence of congressional action at the federal level.”
The bill's author said the legislation was needed to protect the public before advances in AI became uncontrollable.
The Chamber of Progress, a tech industry coalition, praised Newsom's veto, saying “California's tech economy has always thrived on competition and openness.”
Among other things, the measure would have required security testing for many of the most advanced AI models, which cost more than $100 million to develop or require a certain amount of computing power.
AI software developers operating in the state would also need to outline methods for turning off AI models – effectively, an “off switch.”
The bill would have created a state entity to oversee the development of so-called “frontier models” that surpass the capabilities of the most advanced existing models.
The project faced strong opposition from several groups. Google, OpenAI (backed by Microsoft) and Meta, all developers of generative AI models, have expressed their concerns about the proposal. Some Democrats in the US Congress also opposed it.
Among the supporters of the proposal was Tesla CEO Elon Musk, who also runs an AI company called xAI. Amazon-backed Anthropic said the benefits of the project likely outweigh the costs, although it added that there were still some concerning or ambiguous aspects.
Newsom separately signed legislation that requires the government to evaluate potential threats from generative AI to California state infrastructure.
