After a long delay of a year, the Brazilian Senate is about to vote on the bill that aims to establish the rules for artificial intelligence (AI) in the country. The temporary committee in charge of evaluating the project will meet this Tuesday (3) to analyze the report by senator Eduardo Gomes (PL-TO). If the report is approved, the president of the Senate, Rodrigo Pacheco (PSD-MG), plans to take the project to a vote in the plenary on Thursday (5).

Initially, decision-making was supposed to take place by December 2023, but some factors such as municipal elections and obstacles meant that the decision was postponed more than 4 times. The measure in question has as its main objective to bring more legal stability, making Brazil a safer and more attractive option for international investors, especially due to its great potential in clean and renewable energy sources.

Limiting factors for regulation

The artificial intelligence regulation project was experiencing some impasses. On the one hand, the productive sector felt that the rules could be exaggerated and hinder the development of AI in less critical areas, and, on the other, more conservative sectors were afraid that holding platforms accountable would end up limiting freedom of expression. To try to resolve this, the rapporteur made some important adjustments: he removed measures that could increase costs for companies and focused on higher risk technologies, those that really affect people's lives.

Furthermore, he treated micro-enterprises and startups differently, which helped gain the support of entities such as FIESP and the CNI, who were previously against, but are now in favor of the project. Even so, the rapporteur still had to dialogue with the opposition to ensure that the regulation was not seen as a form of censorship
