Bolsonaro's defense says he did not know about the draft of the coup

Bolsonaro's defense argued that there is a confusion in the temporal sequence in relation to the draft of the coup and claims that he did not admit it. For the Federal Police, the former president acknowledged that he was aware of the existence of the document discovered at Anderson Torres' residence, which proposed the imposition of a state of siege.

Confusion in chronological order

Sources linked to Jair Bolsonaro's defense claim that there is a chronological confusion and that the former president did not confess to being aware of a draft coup during his term in office at the event held on Avenida Paulista.

The Federal Police plans to include parts of Bolsonaro's speech on a draft found at Anderson Torres' house in the investigation. According to investigators, due to the former president's speech this Sunday, he would have acknowledged that he was aware of the document.

Bolsonaro said that the alleged coup was recognized through a draft of a state defense decree, and asked whether the coup uses the Constitution. He refused to give a statement to the PF because he did not have access to the entire investigation

According to defense sources, Bolsonaro only became aware of and read the so-called coup minutes after his government, and the only text he received was discovered by the PF on the cell phone of Mauro Cid, a former aide-de-camp.

A screenshot of this draft, which ended up being released by the media, was sent via Whatsapp to Bolsonaro on October 18, 2023 by his lawyers and found in his PL office in a recent search and seizure operation of the PF. A source from the former president's defense said that this entire operation took place long after Bolsonaro left the government.

At the event in Paulista, however, Bolsonaro states that he did not continue with the steps foreseen in the draft. “I make it clear that the state of siege begins with the President of the Republic convening the Republic and defense councils. Was this done? No†said the former president.

In private conversations, Bolsonaro's political allies defend the thesis that the former president may have even received suggestions for state of siege drafts, but that he did not implement them. In addition to the draft by Anderson Torres, Cid stated in his statement that Bolsonaro received from Felipe Martins, also his advisor, another draft, which provided for the arrest of STF ministers, and which would have requested changes. Martins denies the existence of this document, which was not found.
