STJD marks the trial of eight athletes investigated in Operation Maximum Penalty II

O Superior Court of Sports Justice (STJD) scheduled for June 1st, next Thursday, at 11am, the trial of eight athletes who are being investigated in Operation Maximum Penalty II. Players are: Paulo Miranda (without club), Kevin Lomonaco (Bragantino), Edward Bauermann (Saints), Igor Carius (Sport), Moraes (Aparecidense-GO), Matheus Gomes (without club), Gabriel Tota (Ypiranga-RS) and Fernando Neto (St Bernard). There is a risk of banishment and suspension of up to seven hundred and twenty days in some cases.

The judgment that will take place next week refers only to sports justice. The eight players were indicted by the Attorney General’s Office in different CBJD articles.

In the case of athletes Paulo Miranda, Igor Curiús, Moraes, Kevin Lomónaco, Eduardo Bauermann and Fernando Neto, the foreseen punishments are: a fine that, cumulatively, can reach up to R$ 300 thousand; suspension of six to twelve games; Suspension of up to 720 days.

The foreseen punishments will happen according to the articles below:

Art. 191. Failure to comply, or hinder compliance:
III – regulation, general or special, of competition

Art. 243. Deliberately acting in a way that is harmful to the team he defends.
§ 1 If the infraction is committed upon payment or promise of any advantage, the penalty will be suspension of three hundred and sixty to seven hundred and twenty days and elimination in case of recurrence, in addition to a fine of R$ 100.00 to R$ 100,000 ,00.

Art. 243-A. Acting contrary to sporting ethics in order to influence the result of a match, competition or equivalent.

Matheus Gomes and Gabriel Tota, in addition to the texts mentioned above, are also involved in two other articles. The sum of the sentences can reach up to BRL 500 thousand in fines and even banishment from carrying out professional activities in national football.

Art. 242. Giving or promising undue advantage to a member of a sports entity, manager, coach, athlete or any natural person mentioned in art. 1, § 1, VI, so that, in any way, it influences the result of the match, competition or equivalent.

Art. 243. Deliberately acting in a way that is harmful to the team he defends.
§ 2 The author of the promise or advantage will be punished with a penalty of elimination, in addition to a fine, from R$100.00 to R$100,000.00.

Lateral Moraes (ex-Juventude) and defender Kevin Lomónaco (Bragantino) created an agreement with the Public Ministry and ended up becoming witnesses in the case. This decision concerns research outside the sports field. Among the eight athletes who will be judged, the only player who was still on the field for his club before the removal of the STJD was Igor Cariús, at Sport.
