A$AP Rocky released on bail again – Rapper A$AP Rocky is after his arrest Wednesday again on free feet after paying a deposit of more than half a million euros. In other words, he has been released on bail. But what does that actually mean?

Yesterday, Rakim Mayers, better known as A$AP Rocky, was arrested at a Los Angeles airport for a shooting in November. The rapper is suspected of having shot a man after an argument.

Less than three hours later, Mayers was free again after paying a bail of 555,000 dollars (about 504,000 euros).

In the United States, someone who is incarcerated and accused of a crime can be temporarily released by paying bail. In that case, the defendant can await the trial in freedom.

The judge determines the amount based on various factors, such as the seriousness of the alleged crime, the likelihood of committing other crimes after release and the risk of flight.

Such bail does not serve as a punishment, but as a means to ensure that the defendant agrees to certain conditions of the judge, and to ensure that someone does not flee to avoid trial. Examples of conditions include not breaking laws or a restraining order with a victim.

Only if the suspect adheres to all conditions and appears neatly in court, then he will get the money back afterwards. A defendant’s lawyer may propose bail. The judge then has the freedom to determine the amount or refuse the bail.

The U.S. Constitution prohibits “excessive bail.” But that happens anyway: in practice, judges set high bails to prevent the suspect from being released.

The highest amount ever set as bail was in the case of Robert Alan Durst and amounted to $3 billion. Durst was suspected of murdering three people. He was never able to pay the deposit. (Rocky released on bail again)

In our country we also have something like that. “In the Netherlands we have the guarantee, a system that is similar to the American bail,” lawyer Anouar Ibn El Kadi told us.

“The judge can set a sum of money that a suspect must pay so that the pre-trial detention is suspended. But in practice, this will not be used quickly.” The counsel says that he and his colleagues have never experienced it in any case.
