In the summer of 2019, an American judge ordered the publication of thousands of court documents on the sidelines of a defamation action brought by the young woman against Ghislaine Maxwell. The American accuses Epstein and Maxwell in particular of having delivered her to some of their powerful friends to take advantage of her sexually. She names several personalities, including Prince Andrew, who all vigorously deny.

The day after the publication of the documents, Jeffrey Epstein was found dead hanged in the cell of the federal prison in Manhattan where he is incarcerated. The official inquest ruled it a suicide, but the confluence of events has fueled theories that Epstein died so he wouldn’t speak.

For lawyers interviewed by AFP, if the second son of Queen Elizabeth II does not find a financial agreement with the complainant, he will be tried in civil court with a minimal risk for him of a criminal trial.

Following the decision of the judge of the federal court of Manhattan Lewis Kaplan, the lawyers of the British prince can appeal. They even theoretically have the possibility of appealing to the Supreme Court of the United States, but experts doubt that the procedure will go that far.

If all of Andrew’s appeals are dismissed, a civil trial could then be held “between September and December” of this year, Judge Kaplan said in the fall of 2021. In this case, the Duke of York, who “categorically” rejects the accusations of Virginia Giuffre, will have to give a sworn statement in the office of a lawyer, probably in the United Kingdom, and answer questions from American advice from the complainant.

The complaint filed against him cannot be converted into a criminal prosecution for sex crimes. But nothing prevents US prosecutors in the future from initiating criminal proceedings against Andrew if they believe that he may indeed have committed a crime.
